All Abilities Active Terms and Conditions

1.Agreement

By booking a session, enrolling in a monthly membership, or otherwise participating in activities delivered by All Abilities Active, you confirm that you have read, understood, and agree to be legally bound by these Terms and Conditions. These Terms form a binding agreement between you and All Abilities Active.

2.Stay and Play Requirement

All All Abilities Active sessions operate as stay and play sessions. Parents or carers must remain on site for the full duration of each session and supervise and remain fully responsible for their child at all times. All Abilities Active coaches lead and structure sessions but do not provide one to one supervision and do not assume responsibility for the direct supervision of individual children. Failure to remain present and available may result in the child being unable to participate and no refund will be issued in such circumstances.

3.Participation and Behaviour

Participation in sports and physical activity involves inherent risks, including the risk of injury. By attending sessions, you acknowledge and accept these risks on behalf of yourself and your child. While sessions are designed to be inclusive, structured and risk assessed, All Abilities Active cannot eliminate all risk. To the fullest extent permitted by law, All Abilities Active accepts no liability for injury, loss or damage arising from participation except where caused by proven negligence.

We are committed to maintaining a calm, inclusive and positive environment. If a child’s behaviour places themselves or others at risk, we reserve the right to pause participation, adapt activities, request additional parental support, or in serious or repeated cases, withdraw the child’s place. We will seek to work collaboratively with families wherever possible before taking further action.

4.Physical Guidance and Support

Due to the nature of our sessions and the needs of some children, minimal and appropriate physical guidance may occasionally be necessary. This may include guiding movement, supporting balance or preventing immediate danger. Where possible, parents or carers will be asked to assist first. Any physical support provided by a coach will be delivered openly, appropriately, proportionately and in line with our Safeguarding Policy. By attending sessions, you provide consent for such limited physical guidance where reasonably necessary for safety and support.

5.Health and Medical Information

Parents or carers must provide accurate and complete medical, behavioural and emergency contact information at the time of booking and must inform us of any relevant diagnoses, allergies, injuries, medication requirements or additional needs. You must notify us promptly of any changes to this information. We reserve the right to refuse or withdraw participation if we reasonably believe that a child’s medical or support needs cannot be safely met within the session environment.

6.Fees and Payments

Monthly Memberships

Membership fees are payable monthly in advance and operate on a rolling basis. A minimum of 30 days written notice is required to cancel a membership. Payments are non refundable once processed except where required by law. Missed sessions are not refunded or credited unless at the sole discretion of All Abilities Active.

Trial Sessions

Trial session fees are non refundable unless a session is cancelled by All Abilities Active.

If payments are not received when due, we reserve the right to suspend participation until outstanding amounts are settled.

7.Cancellations by All Abilities Active

If a session is cancelled by All Abilities Active due to unforeseen circumstances including but not limited to venue closure, staff illness, adverse weather or events outside our reasonable control, we will offer a credit or provide an alternative session where reasonably possible. Our liability is limited to the value of the session fee paid and we are not responsible for any indirect or consequential costs incurred.

8.Photography and Media

Photographs or videos may be taken during sessions for promotional, marketing or training purposes. Specific consent will be requested at the point of booking. Images will not be used without prior permission. Consent may be withdrawn at any time in writing and will apply to future use.

9.Safeguarding

All Abilities Active is committed to safeguarding and promoting the welfare of children. All coaches hold appropriate DBS checks and have completed safeguarding training. Any safeguarding concerns will be managed in accordance with our Safeguarding and Child Protection Policy. A copy of this policy is available upon request.

10.Personal Property

All Abilities Active accepts no responsibility for loss, theft or damage to personal belongings brought to sessions. Property is brought to sessions at your own risk.

11.Termination of Membership

We reserve the right to suspend or withdraw a child’s place with immediate effect where Terms and Conditions are repeatedly breached, behaviour consistently compromises safety, payments remain outstanding, or where continued participation is deemed not to be in the best interests of the child or others. Where appropriate, reasonable notice will be provided.

12.Data Protection

All Abilities Active processes personal data in accordance with the UK GDPR and the Data Protection Act 2018. Personal data is collected and processed for the purposes of registration, safety management, communication, billing and session administration. Data is stored securely and will not be shared with third parties except where necessary for safeguarding, legal compliance or legitimate business operations. You have the right to request access to, correction of or deletion of your personal data in accordance with applicable law.

13.General

All Abilities Active reserves the right to update these Terms and Conditions from time to time. The most current version will apply to all bookings and memberships. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

14.Acceptance

By completing a booking or enrolling in a membership, you confirm that you have read, understood and agree to these Terms and Conditions.
